Trust Declaration

By using Meen Msefer, all users acknowledge and agree to the following commitments, responsibilities, and limitations:
1. Sender's Commitment
The Sender represents and warrants that they will not send, request the transportation of, or attempt to transport any illegal, prohibited, restricted, dangerous, or regulated items through the Platform.
The Sender is solely responsible for ensuring that all items comply with the laws, customs requirements, and transportation regulations applicable in the countries of origin, transit, and destination.
2. Carrier's Commitment
The Carrier agrees to exercise reasonable care and diligence in handling, transporting, and delivering any item accepted through the Platform.
The Carrier commits to take appropriate measures to protect transported items from loss, theft, damage, or deterioration during transportation.
3. Direct Payment Between Users and Free Platform Service
The Sender and the Carrier acknowledge and agree that all transportation fees, costs, and related payments are negotiated, arranged, and paid directly between them.
Meen Msefer does not collect, process, hold, transfer, receive, facilitate, or guarantee any payment related to transportation services. The Platform acts solely as an intermediary connecting users.
Access to and use of the Platform's matching service is currently provided free of charge, and Meen Msefer does not receive any commission, fee, or percentage of any transaction between users.
4. User Responsibility
Both Senders and Carriers acknowledge that they are solely responsible for their actions, agreements, communications, and obligations arising from their use of the Platform.
Meen Msefer is not a party to any transportation agreement, transaction, or arrangement entered into between users.
5. Loss, Damage, Theft, or Delay
The Sender and the Carrier acknowledge and agree that Meen Msefer does not take possession, custody, control, handling, storage, or transportation of any item exchanged through the Platform.
Any loss, theft, damage, delay, destruction, deterioration, or misdelivery of an item during transportation shall be the sole responsibility of the parties involved in the transaction. Any dispute relating to such matters must be resolved directly between the Sender and the Carrier.
To the fullest extent permitted by applicable law, Meen Msefer shall not be liable for any loss, damage, theft, destruction, delay, or consequential damages arising from or related to the transportation of items arranged through the Platform.
6. Carrier's Right to Inspect and Refuse Items
The Carrier has the right to request information about the contents of a package and may refuse to transport any item that appears suspicious, unsafe, prohibited, illegal, regulated, or inconsistent with the description provided by the Sender.
The Carrier may also refuse, cancel, or decline the transportation of any item before taking possession of it, with or without providing a reason. Nothing on the Platform shall be construed as creating an obligation for a Carrier to accept or complete a transportation request.
7. Delivery Efforts After Acceptance
Once the Carrier has voluntarily accepted an item and taken possession of it, the Carrier agrees to make reasonable efforts to transport and deliver the item in accordance with the agreement reached with the Sender.
8. No Warranty by the Platform
Meen Msefer provides a platform that facilitates introductions and communications between users. The Platform does not guarantee the performance, reliability, legality, safety, suitability, availability, or successful completion of any transportation arrangement between users.
All transportation arrangements are made at the sole risk and responsibility of the Sender and the Carrier.
9. Payment Responsibility
The Sender is solely responsible for paying the transportation fee agreed upon with the Carrier. Any dispute regarding pricing, payment, reimbursement, or any other financial arrangement must be resolved directly between the Sender and the Carrier.
Meen Msefer is not responsible for collecting, enforcing, guaranteeing, or recovering any payment owed by one user to another.
10. Flight Changes, Delays, and Travel Disruptions
The Carrier agrees to promptly inform the Sender of any flight cancellation, itinerary modification, travel disruption, or unforeseen circumstance that may significantly affect the transportation or delivery of the item.
If such circumstances are expected to result in a delay exceeding twenty-four (24) hours beyond the originally anticipated delivery schedule, the Carrier shall make reasonable efforts to notify the Sender as soon as reasonably practicable.
11. Inability to Complete Transportation
If, after accepting an item, the Carrier becomes unable to complete the transportation due to flight cancellation, travel disruption, legal restrictions, personal circumstances, force majeure events, or any other unforeseen circumstance, the Carrier shall make reasonable efforts to notify the Sender and work in good faith toward an appropriate solution.
Such a solution may include delaying delivery, returning the item to the Sender, or any other mutually acceptable arrangement.
12. Return of Items
If transportation cannot be completed and the item must be returned, the Sender and the Carrier shall cooperate in good faith to arrange the return of the item.
Unless otherwise agreed between the parties, any costs associated with returning the item shall be borne by the Sender. The Carrier shall make reasonable efforts to return the item or reach an alternative arrangement with the Sender but shall not be required to incur unreasonable expenses, travel, or logistical burdens in doing so.
Meen Msefer shall not be responsible for organizing, financing, or carrying out the return of any item.
13. Minimum Age Requirement
Users must be at least eighteen (18) years old and legally capable of entering into binding agreements under the laws applicable to them. By using the Platform, users represent and warrant that they satisfy these requirements.
14. Right to Suspend or Terminate Accounts
Meen Msefer reserves the right, at its sole discretion, to suspend, restrict, or terminate any user account that violates this Trust Declaration, the Terms of Service, applicable laws, or the safety and integrity of the Platform.
Such actions may be taken with or without prior notice where permitted by applicable law.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Meen Msefer, its owners, directors, officers, employees, affiliates, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:
- the transportation of any item;
- any agreement between users;
- loss, theft, damage, delay, destruction, deterioration, or misdelivery of items;
- failure of payment between users;
- cancellations, travel disruptions, or changes in travel plans;
- the actions, omissions, conduct, or negligence of any user.
In all circumstances, the total liability of Meen Msefer arising out of or related to the use of the Platform shall be limited to the maximum extent permitted by applicable law.
16. Indemnification
Users agree to indemnify, defend, and hold harmless Meen Msefer, its owners, directors, officers, employees, affiliates, and representatives from and against any claims, demands, actions, liabilities, damages, losses, costs, expenses, fines, penalties, and legal fees arising out of or related to:
- their use of the Platform;
- their transportation activities;
- their violation of applicable laws or regulations;
- their breach of this Trust Declaration or the Terms of Service;
- any dispute between users.
17. Force Majeure
Meen Msefer shall not be liable for any delay, interruption, failure, or inability to provide services resulting from events beyond its reasonable control, including but not limited to natural disasters, pandemics, governmental actions, airport closures, transportation disruptions, strikes, war, civil unrest, terrorism, telecommunications failures, power outages, or technical failures.
18. Governing Law and Jurisdiction
This Trust Declaration and any dispute, claim, or controversy arising out of or relating to the use of the Platform shall be governed by and construed in accordance with the laws of the Republic of Lebanon.
Any legal action, proceeding, or dispute arising out of or relating to the Platform shall be subject to the exclusive jurisdiction of the competent courts of Lebanon.
19. Severability
If any provision of this Trust Declaration is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
20. Modifications
Meen Msefer reserves the right to modify, amend, or update this Trust Declaration at any time.
Continued use of the Platform following the publication of any modification constitutes acceptance of the revised terms.
